2. Is this Islamically legitimate without a marjaʿ?

Yes — and it's important to clarify why.

The authority of a marjaʿ is not divinely appointed nor theologically absolute. It is a functional system of legal reference designed to help regulate religious rulings and guide the community in the absence of the Imams. While marājiʿ provide valuable structure and insight, there is no scriptural, Qur'anic, or hadith-based evidence requiring that only a marjaʿ or his wakīl can review or validate a faskh (annulment) case.

Historically, and throughout classical Shia thought, when a ḥākim sharʿī (qualified judge) or his agent is not available, rulings were handled by a just, God-conscious believer (muʾmin ʿādil)—particularly in times of the Minor Occultation and early post-ghayba centuries, before the marjaʿiyya became formalized.

4. I can’t afford the full fee. What can I do?

We understand that many sisters are in difficult financial situations.
